Ireland proposes personalised professional-services withholding rates

Published 2 min read

On 6 October 2026, Ireland’s Minister for Finance proposed replacing the flat 20% professional services withholding tax deduction with personalised rates. The Budget 2027 announcement makes commencement subject to a ministerial order, allowing engagement with stakeholders before the reform takes effect.

Which payments are affected

Professional services withholding tax, or PSWT, operates under Chapter 1 of Part 18 of the Taxes Consolidation Act 1997. It applies to specified professional-service payments by accountable persons, including government departments, local authorities and certain State bodies. The scheme covers services such as engineering, accountancy, finance and legal work; it does not apply to every commercial payment.[2][3][5][6]

The existing deduction

Section 520 links the deduction to the standard income tax rate and excludes VAT from the amount on which it is calculated. Section 523 places the deduction obligation on the accountable payer. Revenue currently instructs those payers to deduct 20%, submit payment notifications through its electronic PSWT system and remit the deductions monthly.[2][3][4][6]

Withholding and final tax differ

The deduction is collected before the recipient’s final tax liability is settled. Section 526 allows a company to credit qualifying PSWT against corporation tax for the relevant accounting period and claim an excess refund. Section 527 provides conditional interim refunds. The difference between withholding and the eventual liability can therefore affect cash flow even where the deduction is ultimately recoverable.[2][3][4][8]

Non-resident service providers also fall within the existing scheme. Revenue provides a repayment process for non-residents who do not pay Irish tax. Cross-border professional-service groups receiving payments from accountable bodies therefore have an interest in both the proposed rate reform and the existing documentation needed to recover deductions.[2][7][8]

Rates and commencement remain open

The Budget announcement establishes the proposed move to personalised rates but does not specify the new numerical rates or their allocation rules. Those details matter for payment systems and cash-flow forecasts. The reform remains a proposal; the announced commencement-order condition does not establish a start date or authorise payers to stop applying the existing rules.[1][4][6]
