Bermuda prescribes tax-credit registration and group claim procedures

Published 2 min read

On 9 October 2026, Bermuda published the Tax Credits (Administrative) Regulations 2026, establishing group registration, claim and payment procedures under the Tax Credits Act 2025.

Official document:
BR 114/2026; Tax Credits Act 2025 sections 2–4, 33–42
Development date:
2026-10-09

BR 114/2026 was made under section 42 of the Tax Credits Act 2025. It does not create the underlying credits: section 3 already permits the filing entity to claim benefits for qualifying group members for fiscal years beginning on or after 1 January 2025. Section 4 distinguishes qualifying Bermuda constituent entities, whose distributable benefits enter adjusted corporate-tax payments, from qualifying non-constituent entities, whose benefits are paid to the group’s filing entity.[2][3][5]

Registration is required to receive or apply benefits. Existing corporate-tax registration carries across for a qualifying constituent entity unless CITA notifies otherwise. A qualifying non-constituent entity must register at least 30 days before the original claim deadline, subject to CITA’s power to vary the period. Prescribed registration changes must be updated within 90 days. Registration or filing does not itself establish eligibility.[2][4]

A qualifying group must designate a member to file its claim. A single-entity group has an automatic designation; where membership matches the corresponding corporate-tax constituent-entity group, the existing corporate-tax filer is used automatically unless another designation is made. The ordinary claim deadline is the end of the tenth month after the fiscal year, disregarding the Act’s section 33 part-year rule. Non-business-day deadlines move to the next Bermuda business day.[2]

For qualifying non-constituent entities, payment is generally due within six months after the original claim deadline or later filing, with extensions for agency corrections and open enquiries or assessments. An overstated payment must be repaid within 30 days. The rules restrict payment where the entity ceases to be a Bermuda entity. Constituent entities’ benefits instead enter adjusted tax payments, not an unconditional cash-refund entitlement.[2][3][5]

Late claims and corrections

Section 36 of the Act reduces benefits for late claims: the factor is 95% through the first month after the deadline, 75% through month six, 50% through month twelve, 25% through month eighteen and zero thereafter. Regulation 16 protects qualifying good-faith amendments where the original filing and amendment lack negligence or careless, reckless or intentional disregard.[2][3]

Claims can ordinarily be amended within three years of the original deadline, with specified extensions. Supporting records normally run for five years after filing, potentially longer where an agreed assessment period is extended. The rules also prescribe enquiry and assessment procedures, including 60 days to respond to a proposed assessment. Multinational groups should therefore check their tax-credit group boundary and filing designation separately from corporate-tax registration and retain evidence supporting the claimed benefit.[2][3][4]
