Malaysia proposes wider Federal Territories entertainment duty relief

Published 2 min read

On 9 October 2026, Malaysia’s Prime Minister and Minister of Finance, Anwar Ibrahim, proposed full entertainment duty relief for local films and theatre in the Federal Territories from 2027, alongside relief for events at Stadium Merdeka and Stadium Negara.

Official document:
Budget 2027 Tax Measures, Appendices 35–36; Entertainments Duty Act 1953 [Act 103], sections 2, 4 and 12
Development date:
2026-10-09

Category relief and application dates

Appendix 35 proposes extending selected entertainment exemptions announced in Budget 2024 until 31 December 2030. Its comparison describes post-exemption rates of 10% for categories including cinema, theatre and international stage performances; 5% for theme parks and specified recreation facilities; and zero for local-artist stage performances. These are the Budget’s stated baseline, not an independently certified chain of current approvals.[1]

The proposed full exemption for local cinema screenings and local theatre performances covers applications received by the Ministry of Finance from 1 January 2027 to 31 December 2030. For the selected entertainment categories, the proposed application deadline is 31 December 2030. Application receipt, rather than an assumed performance-date test, is the Appendix’s stated timing criterion.[1]

Separate venue-based proposal

Appendix 36 separately proposes relief from 1 January 2027 for arts, cultural, entertainment and sporting activities at Stadium Merdeka and Stadium Negara. The speech links this measure to restoring the two heritage venues. For local films and theatre, it encourages state governments to follow the Federal Territories approach; that invitation does not itself establish equivalent state relief.[1][2]

An exemption proposal, not a new statutory rate

The underlying law is the Entertainments Duty Act 1953, Act 103. Its Attorney General’s Chambers online text, updated to 30 December 2023, describes duty on paid admissions under section 4. Section 12(1) permits conditional exemptions by gazetted order: paragraph (a) covers classes of entertainments, while paragraph (b) covers individual entertainments in the Federal Territories. Section 12(2) separately provides for State Authority exemptions.[3]

For cinema, venue and event groups, this distinction matters when modelling admission revenue and tax exposure: the Budget announcement is not itself a gazetted exemption or an approval for a particular event. Section 2’s definitions encompass paid access to entertainment facilities as well as audiences. Operators should distinguish the proposed category and venue routes and confirm the applicable conditions before claiming relief; the dated statutory text is not a certification of every subsequent exemption.[3]
