Austria’s National Council approves Qatar dividend-tax protocol

Published 2 min read

On 14 October 2026, Austria’s National Council approved a protocol amending its tax treaty with Qatar. The changes would introduce a portfolio-dividend source-tax ceiling and new anti-abuse provisions, but the approval does not make them immediately applicable.

Official document:
National Council decision 219/BNR; Austria–Qatar protocol signed 3 May 2026, Articles 1–7; existing agreement BGBl. III No.52/2012, Articles 4, 8, 10 and 27
Development date:
2026-10-14

An approval step, not commencement

Federal Council consent is also required. Parliament’s dossier records transmission on 15 October, committee consideration scheduled for 20 October and a plenary agenda for 22 October. These entries do not establish completed ratification or entry into force.[3][4]

Dividend exemption becomes conditional

The existing agreement, published as BGBl. III No. 52/2012, generally reserves cross-border dividends to the recipient’s residence state. Article 10(3) already excludes holdings effectively connected with a permanent establishment or fixed base in the payer’s state. That connection exception is not replaced by the protocol.[5][6]

Protocol Article 3 would introduce a 10% gross-dividend source-tax ceiling for resident beneficial owners. Exemption would remain for qualifying states and government entities, and beneficial-owner companies other than partnerships directly holding at least 10% of the payer’s capital. Article 6 defines the government-entity category and extends the Qatari residence provision accordingly.[2][7]

Business and anti-abuse changes

Article 5 would add a principal-purpose test with an object-and-purpose exception. Article 2 would shift international shipping and aviation profits to enterprise-residence taxation, including incidental rentals. Article 4 would allow other uses of exchanged information only where both countries’ laws permit and the supplying authority authorises them.[2][7]

Timing and group implications

Under Article 7, the protocol enters into force on the later diplomatic notification of completed domestic procedures. Withholding changes apply to amounts paid or credited from the following 1 January; other taxes concern taxable years beginning from that date.[2]

For multinational groups, the important distinction is between qualifying substantial holdings and portfolio investments: the latter could lose the current source exemption. Tax teams should map ownership, beneficial entitlement and payment timing before modelling cash repatriation. They should not change withholding instructions solely because the National Council approved the protocol. The Finance Committee confirms that the BEPS multilateral instrument does not apply in this bilateral relationship.[3][5][6]
