Czech chamber consents to Tanzania tax treaty ratification

Published 2 min read

On 15 October 2026, the Czech Chamber of Deputies consented to ratification of the Czech–Tanzania income tax agreement. The vote advances the treaty’s parliamentary approval process; it is not itself an entry-into-force announcement.

The chamber approved the consent motion by 116 votes to none, with 126 deputies present. Its official stenogram reproduces the ratification-consent wording, although the transcript is labelled uncorrected and unauthorised. The agreement signed on 14 May 2025 covers Czech individual and legal-person income taxes and Tanzanian income taxes under the Income Tax Act, Cap. 332; Article 1 applies it to residents of either or both states.[1][2][3]

Payment limits and conditions

Articles 10–12 would cap source-state tax at 7.5% of gross dividends, 10% of interest and 15% of royalties where the beneficial owner resides in the other state. The interest article also provides residence-state-only taxation for specified government, central-bank and investment/export-promotion financing. Effectively connected permanent-establishment or fixed-base income follows the relevant business or independent-services rules instead.[2]

Article 13 separately permits source taxation of managerial, technical and consultancy fees, capped at 12.5% of gross fees for a qualifying beneficial owner. It excludes payments to the payer’s employee, qualifying teaching payments and individuals’ personal-use services. Its payer and permanent-establishment sourcing rules matter: it is not simply a services exemption whenever a supplier has no local office.[2]

For operating businesses, Article 5 includes construction, installation, assembly or related supervision lasting more than six months, and services exceeding six months in aggregate within any twelve-month period. Article 7 allocates business profits to a permanent establishment and also permits taxation of same or similar goods sales in that state. Article 22 preserves domestic taxation of income and profits from local natural-resource exploration, extraction or exploitation.[2]

Article 24 provides capped tax credits to eliminate double taxation. For a Tanzanian resident receiving a Czech dividend, its underlying-tax credit also requires direct or indirect ownership of at least 5% of the payer’s capital. Article 29 denies benefits where obtaining them was a principal purpose, unless granting the benefit accords with the relevant provisions’ object and purpose.[2]

Notifications govern application

Article 31 ties entry into force to receipt of the later diplomatic notification that domestic procedures are complete. Withholding provisions then apply to income paid or credited from 1 January of the following calendar year, and other income taxes to taxable years beginning from that date. Information exchange has a separate timing rule. Groups must distinguish the consent vote from the treaty’s notification and tax-application mechanisms: this report does not establish an actual entry-into-force or application date.[2]
