Portal cutover and corrections
Earlier XML versions will no longer be accepted from that date. The notice covers all CRS reports submitted through the portal and asks institutions to coordinate upgrades with software suppliers and internal technology teams. It also asks for corrections to historical filings, including previously omitted reportable accounts, to be submitted no later than 30 November 2026. This is a transition request, distinct from the ordinary annual filing timetable.[1]
Existing statutory framework
The reporting framework is Part III of the Mutual Legal Assistance (Tax Matters) Act, Revised Edition 2020. Section 30 requires electronic returns in the form and manner specified by the competent authority, incorporating electronic validation; a return filed otherwise must be treated as not filed. Section 12 of the 2022 amending Act substituted section 22 to identify the International Tax Authority as the CRS competent authority. The portal format therefore matters to filing compliance, not merely presentation.[3][4]
The substantive amended CRS is already effective from 1 January 2026 under section 26A(1), inserted by section 3 of the Mutual Legal Assistance (Tax Matters) (Amendment) Act 2026, No. 1 of 2026. The October notice reminds institutions about additional data and due-diligence requirements, including controlling-person roles and certain electronic-money and central-bank-digital-currency products. These obligations were not first enacted on 16 October.[1][2]
Role-information transition remains relevant
Section 26A(2) contains a specific qualification. For reportable accounts maintained on 31 December 2025, and reporting periods ending by the second calendar year following that date, information about the roles in which reportable persons are controlling persons or equity-interest holders is required only if it is available in the institution’s electronically searchable data. That targeted relief should not be mistaken for a general exemption from CRS reporting.[2]
For financial groups with BVI reporting institutions, the practical implication is to review outstanding corrections, data mapping and output generation together. Changing the XML format does not replace the legal assessment of which accounts and information must be reported. Institutions should apply the relevant transitional conditions while preparing for portal acceptance of Schema 3.0 only.[1][2][3]
