US opens emissions-value request route for clean-fuel tax credit

Published 2 min read

On 16 October 2026, the US Department of Energy published a Federal Register notice opening its emissions-value request process for the section 45Z clean-fuel production credit. The process supports Treasury petitions for fuel pathways missing from the applicable emissions-rate table.

Official document:
DOE notice 2026-21217, 91 FR 65737; Internal Revenue Code section 45Z
Development date:
2026-10-16

The published notice follows DOE’s 14 October announcement and its July 2025 consultation. It confirms availability of an administrative process, rather than creating a new credit or finalising Treasury’s separate tax regulations. DOE’s assessment supplies an emissions value for the producer’s subsequent provisional emissions rate petition.[1][2]

Why a missing pathway matters

Section 45Z calculates the credit using a per-gallon amount and an emissions factor. Section 45Z(b)(1)(B) provides for annual emissions-rate tables; subsection (b)(1)(D) permits a producer to petition Treasury where a rate has not been established. The notice identifies missing fuel types, primary feedstocks or production pathways as the relevant cases.[1][3]

DOE’s announcement asks for a completed request form and engineering information consistent with specified sections of a front-end engineering and design study, or a similar indication of project maturity as DOE determines. Additional information may support the lifecycle analysis. The process therefore requires evidence about the production pathway, not merely a proposed tax-credit figure.[2]

DOE evidence and Treasury treatment are different steps

Treasury’s February 2026 proposed regulations describe obtaining a DOE calculated emissions value letter before filing the tax petition. Their reliance provision permits taxpayers to follow the proposed regulations until final regulations are published, provided they follow them in their entirety and consistently. The new DOE notice does not turn those proposals into final regulations.[4][1]

For multinational fuel groups, obtaining a DOE value is not confirmation of credit entitlement. Section 45Z separately addresses qualified production and sales, registration at production, facility exclusions and other conditions. The October notice does not waive those requirements or announce a general extension to fuel produced outside the United States.[3][1]

Our practical reading is to check table coverage and organise engineering evidence alongside, rather than in place of, the separate tax-eligibility review. The applicable Treasury procedures and production-year rules still govern the eventual claim.[1][2][3][4]
