UAE replaces e-invoicing penalty rules and caps implementation fines

Published 2 min read

On 30 October 2026, the UAE Ministry of Finance published Cabinet Decision No. 173 of 2026, replacing the e-invoicing penalty decision and capping specified implementation fines; its exact commencement awaits the Official Gazette publication date.

Official document:
Cabinet Decision No. 173 of 2026 on e-invoicing violations and administrative penalties
Development date:
2026-10-30

Who the decision covers

Decision No. 173 applies to violations of the legislation regulating the Electronic Invoicing System. It excludes a person that issues, transmits, shares, exchanges or reports electronic invoices or credit notes voluntarily. Where the same person acts as issuer, recipient or both for the same violation, Article 3 permits only one administrative penalty for that violation.[1]

Implementation penalties are capped

Failure by an issuer or recipient to implement the system, including failure to appoint an Accredited Service Provider, attracts AED 5,000 for the first instance and AED 5,000 for each month or part of a month during which non-compliance continues. The same structure covers a recipient that implements the system but later fails to maintain its recipient obligations. Total fines for these violations may not exceed AED 50,000 in any 12 consecutive months.[1][2]

Document and data-change penalties

An issuer that fails to issue and transmit an electronic invoice faces AED 100 for each invoice, capped at AED 5,000 per calendar month; the decision applies the same amounts separately to electronic credit notes. Failure by an issuer or recipient to notify its appointed service provider of changes to data registered with the Federal Tax Authority attracts AED 250 for each day or part of a day, capped at AED 5,000 per calendar month. The Ministry also confirms that the former system-failure notification penalty has been removed.[1][2]

Commencement and phase dates stay distinct

The decision repeals Cabinet Decision No. 106 of 2025 and states that it comes into force on the day after publication in the Official Gazette. The official English text and the Ministry's 30 October announcement do not identify that Gazette date, so no effective date is inferred here. Separately, the first implementation phase still requires an in-scope person with revenue of at least AED 50 million to appoint a service provider by 30 October 2026 and implement by 1 January 2027; the penalty decision does not itself change those dates.[1][3][4]

Practical review

Groups should map each UAE entity's actual issuer and recipient activity, onboarding status and structured-invoice processes, then determine the applicable implementation phase from the current scope rules and records. The AED 50 million test uses the legal definition of revenue and should not be approximated from a different period or currency. The fine caps do not remove the underlying obligation, and no penalty should be calculated until the Gazette commencement and the facts of the specific violation are established.[1][3][4]
