Brazil Supreme Court excludes ISS from the PIS and Cofins base

Published 2 min read

On 23 October 2026, Brazil’s Supreme Federal Court published the minutes of its 21 October decision excluding municipal services tax from the PIS and Cofins base; compensation and possible temporal limitations remain separate issues.

Official document:
RE592616, Theme118; Constitution195(I)(b) as amended by EC20/1998
Development date:

The majority decision in Extraordinary Appeal 592616, general-repercussion Theme 118, concerns the ISS charged on services. The court treated that amount as a receipt passing temporarily through the supplier’s accounts to the municipality, rather than the supplier’s own revenue or turnover for the federal contributions.[1][2]

Its constitutional basis is article 195(I)(b) of the Federal Constitution, in the wording introduced by Constitutional Amendment 20/1998. The fixed thesis excludes the corresponding ISS amount from the PIS and Cofins calculation base. This is a judicial interpretation, not a new statutory tax rate or an exemption from ISS itself.[2]

The result has general repercussion and is intended to govern similar cases in the courts. However, the operative record grants the appeal only for the base exclusion. It does not decide the requested tax compensation, which the court treated as an issue below constitutional level.[1][2]

The STF’s announcement also says the court did not examine temporal modulation, which could be considered if clarification appeals are filed. The current docket records preparation of the full judgment after publication of the minutes; it does not establish that all appeal questions are finished.[1][2]

Groups with Brazilian service operations should therefore distinguish the exclusion principle from the procedure and periods for any adjustment or recovery. The decision supplies no new filing deadline or automatic compensation route; neither should be inferred from the publication date.[2]
