Netherlands Senate approves targeted excise return and payment changes

Published 2 min read

On 27 October 2026, the Dutch Senate approved the Fiscale verzamelwet 2027, including targeted changes to excise return and payment deadlines. The bill extends two cross-border cases but shortens the period for specified movement irregularities; promulgation is not yet established.

Certified recipients and foreign sellers

Article XIII(B) amends Article 53a of the Wet op de accijns. For certified recipients receiving goods already released for consumption in another EU Member State, proposed Article 53a(e) allows payment on return by the Friday following the week of receipt. The explanatory memorandum identifies the existing deadline as the day after the taxable event. This is not a new weekly concession for registered recipients: their existing weekly rule is reorganised without changing the deadline.[2][3]

Proposed Article 53a(f) likewise uses the Friday following the week of delivery for an Article 2f sender in another Member State. The memorandum describes a foreign distance seller that does not appoint a Dutch fiscal representative and instead files itself. Its existing day-after-delivery deadline would be extended. These conditions matter: the provision is not a blanket extension for every excise importer, warehousekeeper or seller.[2][3]

A shorter irregularity deadline

For non-compliance or defective compliance within Article 4(6), proposed Article 53a(g) instead requires payment on return by the day after the non-compliance is established. The memorandum contrasts this with the existing month after the inspector establishes the irregularity. Groups should distinguish this enforcement-related case from compliant duty-paid movements and identify the relevant taxable event before selecting a return period.[2][3]

Do not change calendars from the vote alone

A separate Article 2e amendment excludes receipt from release for consumption where the certified recipient also holds the excise-warehouse authorisation and immediately enters the goods into that warehouse. The bill specifies general commencement on 1 January 2027, but enactment and promulgation remain unverified. Groups should check the final legislation, authorisations, movement and taxable event before changing calendars. The wider omnibus-package review remains open.[1][2]
