Netherlands Senate approves MAP interest-relief correction

Published 2 min read

On 27 October 2026, the Dutch Senate approved the Fiscale verzamelwet 2027, including a correction expressly covering interest reduction in mutual agreement procedures under the Wet fiscale arbitrage. Parliamentary approval is not confirmation of promulgation.

Official document:
Fiscale verzamelwet 2027, bill 36.938, Articles XIX(E), XX(A) and XXIX(1)(j); AWR Article 30k; Invorderingswet 1990 Article 31a
Development date:
2026-10-27

The statutory omission

Articles XIX(E) and XX(A) add the Wet fiscale arbitrage to Article 30k of the Algemene wet inzake rijksbelastingen (AWR) and Article 31a of the Invorderingswet 1990. These provisions concern the Minister of Finance’s discretion to reduce tax-assessment interest and collection interest in mutual agreement procedures. The amendments insert the missing statutory reference rather than creating a general interest exemption.[2][3]

Existing practice, not automatic relief

The explanatory memorandum says the omission was accidental: the intended treatment already applied in practice regardless of the legal basis chosen for the procedure. It expressly describes no change in implementation practice. Groups should therefore distinguish this legislative correction from a fresh entitlement to an interest refund or a guaranteed outcome in a cross-border tax dispute.[3]

Retrospective design

Article XXIX provides for general commencement on 1 January 2027 and retrospective effect for these two amendments to 16 July 2019. Those are the approved bill’s terms, not evidence that the law has already entered into force. The Senate dossier records lower-house approval on 6 October and Senate approval on 27 October; enactment and official publication must still be checked.[1][2]

What group tax teams should review

For a group using the Wet fiscale arbitrage, the practical review is the procedure’s legal basis and the treatment of interest alongside the underlying double-tax dispute. Existing official MAP policy already discusses interest reduction under AWR Article 30k and Invorderingswet Article 31a. Neither the correction nor the Senate vote supplies a new filing, payment or registration deadline. This brief addresses the interest provision only, not the other measures in the omnibus bill.[2][3][4]
